What the law actually says

Plain English. No hype, no EU-style promises for an Australian claim.

  • Cancelled flights fail the service test. The ACL guarantees services are provided with due care and skill, fit for purpose, and within a reasonable time. A cancelled flight is a service you paid for and didn't receive — regardless of why it was cancelled [verified 2026-09-28].
  • "Extraordinary circumstances" is a European concept. Australia has no EU261-style fixed compensation scheme [verified 2026-09-28]. But the right to a refund for a service not supplied stands.
  • What the law does not give you: automatic cash for inconvenience or lost time. We don't pretend otherwise — the pack claims your refund plus receipted out-of-pocket costs (hotels, meals, rebooking), nothing invented.
  • Booked through an agent or OTA? The substantive demand goes to the airline (the supplier of the flight), with a processing demand to the agent — so neither can bounce you to the other.
  • Overseas carrier? We'll tell you honestly when enforcement is the problem — some offshore carriers are hard to compel — and route you to parallel lanes (booking channel, card chargeback) instead of selling you a pack that can't work.
Ombuds watch — regulatory update. An airline consumer-protection bill (ACP Bill 2026) is before federal Parliament. The Aviation Consumer Ombuds Scheme is not yet law: the interim ombudsperson has no formal power to resolve airline complaints [verified 2026-09-28, infrastructure.gov.au]. Full operations are expected in 2026/27 after enabling legislation passes [verified 2026-09-28]. Is this like AirHelp?
No. AirHelp is built for EU compensation rules and takes a 25–35% commission. Australia has no EU-style scheme — SkyRefund is built for Australian Consumer Law claims on Australian flights, for a flat $29 with no commission.
What if the airline blames the weather?
The pack addresses this directly: a cancelled flight is a failure to supply the service regardless of cause, so the refund right stands. We'll be straight with you about where recovering extra expenses gets harder.
